Simumba told principal resident magistrate Sylvia Munyinya that he communicated with Tayali through a phone call and he promised to come back when he finds transport money.

This was after the court summoned the sureties to give court an explanation to why they failed to avail the accused person before court.

“The accused is still at large, I have spoken with him and he said he needs money to travel back to Zambia, we even communicated with his family after the matter was adjourned on Wednesday. He said he would call back and he has not called back yet,” Simumba said.

Another surety, Mpika member of parliament, Francis Kapyanga re-echoed the sentiments that their efforts to secure the accused before court has not yet come to fruition.

“Considering that your efforts to bring the accused person before court have failed, I order that each of the surety should pay to the state the sum of K50,000 each by June 16, in default to serve two months simple imprisonment.”

“The bench warrant to be returned upon the arrest of the accused,” Magistrate Munyinya ruled.

In this case, Tayali was dragged to court for alleging that Chief Monokalia Mukuni of the Toka Leya people of Livingstone is the brainchild behind the gassing which happened between 2019 and 2022.
