Lusaka woman sues Juldan Motors for accident that claimed mother’s life

A Lusaka woman, Chanda Mooya, has sued Juldan Motors Limited, demanding K141,870 in special damages following a tragic bus accident that claimed the life of her mother, Miyoba Mooya, and left her daughter, Musonda Banda, severely injured.

The lawsuit, alleges gross negligence on the part of the bus driver, who is accused of dozing off at the wheel causing the accident which occurred on October 15, 2024.

On that fateful day, Juldan Motors bus, BAJ 3715 zm, bound for South Africa, overturned in a drainage in the Kasaka area.

Police reports confirmed that the accident resulted in five fatalities, including Miyoba, and left 29 others injured.

The bus driver was charged by the Zambia Police Service with five counts of causing death by dangerous driving.

Investigations by the Road Transport and Safety Agency (RTSA) revealed that the driver embarked on the long trip despite having returned from South Africa the previous day, and further noted issues with Juldan Motors’ GPS tracking and fleet management.

For Mooya, the legal battle is not just about financial compensation; it’s a desperate cry for justice and accountability for a loss that has torn her family apart.

“The bus driver dozed off while the bus was in motion,” Mooya stated in her court documents.

“The bus driver in process lost control, and the bus overturned and rested in the drainage.”

The impact of Mooya’s mother’s death has been profound as Miyoba was a devoted parent who suffered extensive injuries including a fractured skull and neck, and multiple internal traumas, as detailed in the post-mortem examination.

“By reason of the death, her (Miyoba)’s three children and a dependent have suffered loss, pain, damage and facing a helpless future,” she stated.

Adding to the family’s anguish, Musonda, Mooya’s daughter, sustained a fractured right femur in the crash.

The 15-year-old underwent surgery at Sanjeevani Healthcare and required extensive hospitalisation, incurring K18,500 in medical expenses.

Her physical recovery is ongoing, but the emotional scars of the ordeal run deep.

Chanda Mooya is seeking a comprehensive reimbursement for these burdens, including K20,718 for Musonda’s hospital and nursing expenses, K41,870 for her mother’s funeral and burial costs, and damages for the immense suffering and loss of life.
