The ruling, delivered by Senior Magistrate Lewis Mumba, comes after Banda, known for his hit song “Ali Naine,” sought legal recourse against Kaziya, who he claimed repeatedly hurled insults and damaging accusations about his character, even in front of his wife.
42 year old Banda, a resident of Chaisa compound, testified that Kaziya, whose tongue is as sharp as a double edged sword due to the insults that come out of it, followed him to his shop to publicly shame him.
He lamented that Kaziya insulted him and accused him of sleeping with multiple women in front of his wife.
These accusations, Banda stated, shook the very foundation of his marriage as his wife struggled to reconcile the image of the man she knew with the vile accusations lobbed at him.
“For many years, I have held my reputation as a gospel artiste in high esteem, garnering respect and admiration from both the community and the church but all that was jeopardized by Kaziya’s reckless accusations, which have done untold damage to my image and standing,” Banda shared.
“The people of our community will readily testify to the fact that Kaziya’s verbal abuse is habitual, which is why I felt compelled to seek the court’s assistance in reprimanding him.“
Kaziya, in his defense, attributed his actions to extreme drunkenness, claiming he was unable to control his words.
He regreted harming Banda’s reputation.
Kaziya also claimed that he cannot comprehend losing his friend Banda who is not just a companion but also a soulmate in their shared love of drinking ‘kachasu’ from dawn to dusk.
Presiding over the case, senior Magistrate, Lewis Mumba declared that as a result of derogatory statements made against Banda, the court mandates Kaziya to compensate him with a payment of K3,500.
“You will be required to pay an initial sum of K1,500 by the end of June, followed by monthly installments of K250. This is intended to give you the opportunity to reflect on your actions and facilitate a course of personal reform,” Magistrate Mumba stated.
