I can’t pay for damage without seeing the child, 17 year old tells court

A DEFIANT teenage boy, hailing from Lusaka West, has surpassed the zeal Peter used in denying the messiah, to refuse any responsibility and financial obligations towards his girlfriend’s pregnancy without seeing the child first.

Unmoved by the claim for damages levied against him, the suspect staunchly maintained that he cannot be held accountable for a child he has neither seen nor accepted as his own, asserting that such an expectation is both unfair and illogical.

This is in a case where 45-year-old Scout Banda, father of a 16 year old girl, dragged the teenage boy to court for using his male sprinkler to impregnate his daughter.

Banda demanded a sum of K20,000 as compensation for the damages inflicted upon his daughter however, the suspect failed to pay any of the amount despite accepting, leaving him to seek legal action in order to secure justice for his daughter.

Banda explained that the suspect and his family were supposed to make the initial payment by June 30, 2025 but as of today, they have not provided any information or progress regarding the payment.

After the victim’s pregnancy was revealed, she faced the double rejection of her own family and her boyfriend’s family, leaving her homeless and alone.

In the absence of any support, the victim was forced to seek shelter in an unfinished building, a situation which made it more difficult with a second heartbeat in her stomach.

The girl’s father expressed disappointment at the situation, noting the significant sacrifices he had made to provide for his daughter, only to see her educational opportunities and future prospects disappear as a result of the pregnancy.

“I invested so much in my daughter, only for her to become a grade 8 dropout. All I’m asking for is compensation for what she has gone through, so that I can ensure that she has some semblance of a future, even after this terrible ordeal,” he lamented.

In his defense, the suspect challenged the Court to justify why he should be financially responsible for the unborn child, insisting that without knowing the paternity of the baby, he cannot accept financial liability.

“Manje munaonapo kulipila ndrama ya damage koma mwana akalibe kubadwa (have you seen someone paying for damage when the child is not yet born),” he questioned.

Presiding over the matter, senior magistrate Lewis Mumba lectured Banda by stating that his daughter is a minor and a government trophy, asserting that the suspect can even be arrested for defilement.

“This girl knows nothing, she’s just surprised that the stomach keeps becoming big. Stop taking matters in your own hands all because of money, instead let justice take its course,” he emphasised.

Magistrate Mumba then ordered the suspect to pay a total of K20,000 in damages for his actions.

In addition to this, the payment was structured into monthly installments of K5,000 for the first month, which is August and K1,500 for subsequent months until the entire sum was paid.
