THE Kitwe Subordinate Court has heard harrowing details of how a 69 year old pedophile defiled a nine year old girl at the back of their semi-detached house while the child was crying.
Vincent Muwana, a neighbour regarded by the minor as bashikulu (a grandfather) admitted to one count of defilement contrary to Section 138 of the Penal Code of Zambia.
The court heard that Muwana defiled the little girl on November 5, 2025 around 19 hours at the back of their semi-detached Kawama Compound house when the minor was sent by her aunt to get a bathing soap stand from their outdoor bathroom.
According to facts presented to magistrate Mercy Mugala, the young girl referred to as the prosecutrix in court, noticed Muwana following her.
When she asked why, he commanded her to keep quiet, grabbed her and covered her mouth with his hand.
The little girl told the court that as he covered her mouth, she started crying but no one could hear her.
“The prosecutrix stated that the accused person unzipped his trousers, removed his manhood and her underwear, pulled her onto his laps in a squatting position and started having unlawful carnal knowledge [of] her. She stated that while he was doing that, she was crying,” read the court papers.
The child’s aunt became worried when she noticed that the minor had taken long to come back just from fetching a stand from the bathroom.
Using a light from her mobile phone, the girl’s aunt went to check for her niece in the bathroom and discovered the assault in progress at her backyard.
She told the court that she screamed for help as soon as she set her eyes on the filthy act and some good samaritan neighbours came running to help.
“She saw the now accused person Vincent Muwana who was the block mate to the complainant defiling the prosecutrix in a squatting position while the prosecutrix was on the laps of the accused person.”
“She saw the hand of the accused person covering the mouth of the prosecutrix while she was crying. The complainant was shocked and she screamed for help and some good Samaritans went and together they managed to apprehend the accused person and
took him to Kawama Police Post,” stated Court documents.
The minor was then rushed to the Gender Based Violence (GBV) Buchi Main Clinic for examinations.
“A Clinical Officer examined the prosecutrix and the findings on the Medical Report Form were as follows; “Valva normal, Labias normal, No vaginal discharge, some bruising around the vesabule, hymen with laceration at 1 O’clock and 11 O’clock,” read the documents.
“Her conclusion was that the prosecutrix was sexually abused and that her findings were consistent with the allegation of
defilement.”
The 69 year old pleaded guilty to the charge of defilement and the matter was adjourned to January 29, 2026 for commencement of trial.
