LAZ discontinues case against acting AG

THE Law Association of Zambia (LAZ) has discontinued a case against acting auditor general Ron Mwambwa, where the association petitioned the Constitutional Court, seeking an order that he vacates the office.

LAZ argued that Dr Mwambwa’s appointment as acting auditor general had not been ratified by the National Assembly as required by law since 2023.

The association, through its president Lungisani Zulu, asked the Constitutional Court to declare that the presidential appointment of Dr Mwambwa as auditor general was illegal.

Zulu sought an order for Dr Mwambwa immediately to cease performing the functions of AG, and vacate the office of the auditor general of Zambia.

LAZ also sought an order that all the salaries, allowances and all other emoluments drawn by Dr Mwambwa from the revenues of the republic by virtue of his occupying the office of auditor general, be forthwith paid back to the coffers of the State.

But Dr Mwambwa denied that he was never appointed auditor general of this country and that the press release relied upon by LAZ, which is challenging his appointment is not a letter of appointment to the alleged position.

However, Zulu in an affidavit in support of summons for leave to discontinue the petition, notified the court that he wanted to discontinue the matter.

Zulu through his advocate, Rebecca Kataka Nswana of Messers Malissa and Partners, submitted that the petitioner had instructed them to formally discontinue the petition filed before the court on March 19, 2025.

“That premised on the above,i verily believe that this is the proper case for this court to grant the order declaring this matter as discontinued,” read the document.
