Court warns Mwamba’s arresting officer to attend court or face an arrest

LUSAKA Senior Resident Magistrate Trevor Kasanda has warned an arresting officer in Emmanuel Mwamba’s case to attend court and explain why he has failed to execute the warrant or the same will be extended to him.

The court issued a first warrant against Mwamba on January 31, 2024 for missing a court session twice. And on February 6, this year, the court issued another warrant against him.

The court also made his sureties, Mufulira member of parliament and his counterpart from Musanzala Elias Daka to forfeit a sum of K50,000 each for not presenting the accused before court.

However, when the matter came up this morning for return of bench warrant, senior state prosecutor, Robert Malama informed the court that the arresting officer, Justin Makumba was not present before court and the warrant had not been executed.

Malama then applied for an adjournment for a return of the bench warrant.

Magistrate Kasanda warned that if the arresting officer will not be present at the next sitting, the warrant of arrest will be extended to him.

“Tell the arresting officer to be present at the next sitting otherwise I will extend the warrant to him,” magistrate Kasanda said.

In this matter, Mwamba is accused of strangling and squeezing the neck of a police officer who wanted to arrest him.

Mwamba pleaded not guilty to one count of Assault on a police officer contrary to section 250 (b) of the Penal Code Chapter 87 of the Laws of Zambia.

It is alleged that Mwamba on June 14, 2023 in Lusaka assaulted detective Inspector Steven Simwenda, an officer of the Zambia Police Service, in due execution of his duty.

It is also alleged that the incident happened in Woodlands area on Wednesday June 14, 2023 between 16:00 hours and 18:00 hours

Magistrate Kasanda has since adjourned the matter to August 18, 2025 for return of the bench warrant.
