The court also removed the case from its active list, though it can be reinstated within 30 days.
Kambita had asked the court to rule in his favour, arguing that Lusambo had admitted to owing him K650,000.
This dispute originated from an alleged K850,000 transaction where Kambita claimed Lusambo defrauded him in a house sale.
Kambita was initially seeking a full refund, damages, and other costs.
Lusambo, who is currently incarcerated, had previously told the court he was willing to repay K650,000 in installments.
He claimed to have already paid K200,000 to Kambita through a colleague and was prepared to settle the remaining balance.
However, High Court Judge Sharon Newa dismissed Kambita’s application because he failed to actively pursue the case.
Lusambo was ordered to pay the legal costs.
The court stated that if the case is not restored within 30 days, it will be dismissed permanently due to lack of prosecution.
