AS curious citizens filled up the Lusaka Magistrates’ Court to hear for themselves the evidence of President Hakainde Hichilema’s dark corner meetings with judges, the accuser Raphael Nakacinda instead cried that he had a severe headache that was so painful he could not speak.
The binoculars-carrying PF chairperson for information and publicity is appearing before the Lusaka Magistrates’ Court on a repealed law of defamation of the President.
On December 13, 2021, Nakacinda with intent to bring President Hichilema into hatred, ridicule and contempt caused the publication of defamatory matter when he alleged that the Head of State was summoning judges at his residence to coerce them into promoting totalitarian rule.
Last month the court gave the loud-mouthed Nakacinda an opportunity to cast light on his claims that the Head of State was secretly meeting adjudicators in order to influence the outcome of election petitions involving nine PF members of parliament whose election in the August 12, 2021 polls were nullified.
However Nakacinda could not open his defence this morning on reasons that he had a headache and will have difficulties to crystallize his claims.
His lawyer Nkhula Botha made an application before magistrate Irene Wishimanga to have the case adjourned.
“My client has an acute headache to continue trial we are humbly requesting for an adjournment,” Botha said.
Magistrate Wishimanga granted the application but cautioned Nakacinda against his usual style of attracting media attention for squabbles and and finding faults in President Hichilema
“Being the first time the accused is asking for an adjournment and he’s sick we have no control over sickness. I will give him a benefit of a doubt. But we should not hear you speaking anywhere after this, stay home you are sick,” said magistrate Wishimanga.
She adjourned the matter to May 19, and 31, 2023 for defence.
