Court orders Martha Mushipe’s arrest for shunning hearings

LAWYER Martha Mushipe is facing arrest and possible detention following the Lusaka Magistrates’ Court issuance for her arrest warrant this morning.

In this matter mushipe is facing a charge of seditious practice but has absconded hearings three times.

When the matter came up for continuation of trial before Lusaka Magistrate Felix Kaoma Mushipe and her lawyers Keith Mweemba and Gilbert Phiri were not present before court.

State prosecutor Noah Mwanza made an application that Mushipe be placed on bench warrant as there was no reason for her nonappearance before court neither were her advocates present to state why she was not before court.

In his response Magistrate Kaoma granted the application by the state to have Mushipe arrested.

Magistrate Kaoma noted that Mushipe had not been appearing before court for three consecutive occasions without a reason,

He placed Mushipe on bench warrant to be returned on April 20.

Mushipe is between June 1,2015 and April 11, 2016 alleged to have possessed a seditious document.

The document in question which was authored by general Thendai Muduli, former minister of Justice Ngosa Simbyakula and Didimus Mutasa is a strategy of how the ruling Patriotic Front (PF) would dominate against the opposition United Party for National Development (UPND) from 2015 to‎ 2016 and beyond.

The strategies among others, was the use of ethnic divide and rule as a means of maintaining political control in Zambia from 2015 to 2016 and beyond.

In 2016 police officers sealed off Mushipe’s lawfirm in Millennium village in search of the said seditious document which was later discovered in one of the offices.
